In plain English: We collect only what we need to run your account and process transactions. We never sell your data. You can request deletion of your account and data at any time.
1. Who We Are
Fire Kicks, LLC ("Fire Kicks," "we," "us," or "our") operates shopfirekicks.com — a buy-sell-trade resale marketplace for authenticated sneakers, streetwear, and accessories. This Privacy Policy describes how we collect, use, share, and protect your personal information when you interact with our platform, whether online or at any of our physical retail locations.
This policy applies to all users of our platform, including buyers, sellers, and guests. By using our services you agree to the practices described here.
2. Information We Collect
Information you provide directly
- Account information: Phone number (used for OTP login), name, email address, and profile details you choose to add.
- Shipping addresses: Full mailing addresses used to calculate shipping, calculate tax, and deliver orders.
- Payment information: Payment card details are processed and tokenized directly by Stripe. Fire Kicks never stores raw card numbers, CVVs, or full PANs.
- Sell & trade submissions: Item descriptions, condition details, photos, and requested pricing for items you wish to sell or trade in.
- Communications: Messages you send to our support team or legal department.
Information collected automatically
- Usage data: Pages visited, search queries, products viewed, cart contents, and other interactions with the platform.
- Device & log data: IP address, browser type, operating system, device identifiers, and session timestamps for security and fraud prevention.
- Cookies & local storage: Session cookies for authentication, cart persistence, and user preferences (e.g., dark mode). We do not use advertising or cross-site tracking cookies.
- Geolocation: Approximate location derived from IP address, used to display applicable sales tax and nearby store locations. We do not collect precise GPS coordinates without explicit permission.
Information from third parties
- Stripe: Transaction status, card type (last 4 digits, brand), and fraud signals returned by Stripe after payment processing.
- Shipping carriers: Tracking numbers and delivery confirmation data returned by shipping partners after a label is created.
- Tax calculation providers: Sales tax rates from third-party tax services based on shipping destination.
3. How We Use Your Information
We use the information we collect to:
- Create and manage your account and authenticate your identity via OTP verification
- Process, fulfill, and track orders — both purchases and sell/trade-in transactions
- Calculate accurate shipping costs and applicable sales tax
- Manage your wallet balances (rewards credit, store credit, and gift cards)
- Send transactional communications: order confirmations, shipping updates, and price alerts you subscribe to
- Detect, investigate, and prevent fraudulent transactions and platform abuse
- Authenticate the items you submit for sale or trade using the information and photos you provide
- Improve our platform, search relevance, and product catalog based on aggregate usage data
- Comply with applicable laws, tax obligations, and legal process
We do not use your personal information to serve third-party advertising or build advertising profiles.
4. How We Share Your Information
We share personal information only in the following circumstances:
Service providers
We share data with vendors who process it strictly on our behalf: Stripe (payments), shipping carriers (order fulfillment), tax calculation services, cloud infrastructure providers (server hosting), and SMS/email providers for OTP and transactional messages. These providers are contractually prohibited from using your data for their own purposes.
Peer-to-peer transactions
If you purchase an item from an independent seller on our platform, we share your shipping address and order details with that seller solely to fulfill your order. Sellers are prohibited from using buyer data for any purpose other than fulfilling the specific transaction.
Legal obligations
We may disclose information when required by law, subpoena, court order, or government authority; to protect the rights, property, or safety of Fire Kicks, our users, or others; or to investigate fraud or enforce our Terms of Service.
Business transfers
In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred as part of that transaction. We will notify you via email and/or prominent notice on our platform before your data becomes subject to a different privacy policy.
We never sell your personal information to third parties.
5. Resale Marketplace & Transaction Records
As a resale marketplace, Fire Kicks maintains records of all buy, sell, and trade transactions. These records are necessary for:
- Maintaining authenticity guarantees and provenance records for items resold on our platform
- Issuing accurate 1099-K tax forms to sellers who exceed IRS reporting thresholds
- Resolving buyer/seller disputes and processing returns or authenticity claims
- Complying with state sales tax nexus obligations and applicable financial regulations
- Responding to lawful requests from law enforcement related to counterfeit goods investigations
Transaction records (item sold, sale price, date, parties involved) are retained for a minimum of seven (7) years to satisfy tax and legal compliance requirements, even after account deletion. See Section 9 for details on what can and cannot be deleted.
6. Cookies & Tracking Technologies
We use the following types of cookies and local storage:

We do not use advertising cookies, third-party trackers, or retargeting pixels of any kind.
7. Data Security
We implement industry-standard security measures to protect your information:
- All data in transit is encrypted using TLS/HTTPS
- Session data is encrypted server-side; customer authentication tokens are never exposed to the frontend
- Payment card data is handled exclusively by Stripe — we are PCI-compliant by design and never store raw card information
- OTP authentication codes expire quickly and are single-use; no passwords are stored
- Access to production data is restricted to authorized personnel on a need-to-know basis
- We conduct periodic security reviews and promptly address known vulnerabilities
No system is perfectly secure. If you believe your account has been compromised, please contact us immediately at support@shopfirekicks.com.
8. Children's Privacy
Our platform is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13. Users between ages 13–17 may use the platform only with verifiable parental or guardian consent. If we become aware that we have inadvertently collected information from a child under 13 without parental consent, we will promptly delete that information. 9. Your Rights & Choices
Depending on your location, you may have the following rights regarding your personal information:
Access
Request a copy of the personal data we hold about you.
Correction
Request correction of inaccurate information in your account.
Deletion
Request deletion of your account and associated personal data. Note: transaction records required for tax/legal compliance cannot be deleted (see Section 5).
Portability
Request an export of your data in a machine-readable format.
Opt-out of marketing
Unsubscribe from any marketing communications at any time. Transactional messages (order confirmations, OTP codes) cannot be opted out of while your account is active.
California residents (CCPA)
California residents have additional rights under the CCPA, including the right to know categories of data collected and to opt out of data sales (we do not sell data, but the right applies).
To exercise any of these rights, email us at privacy@shopfirekicks.com. We will respond within 30 days. We may need to verify your identity before processing the request.
10. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this policy:
- Account data: Retained while your account is active; deleted within 30 days of an account deletion request.
- Transaction records: Retained for 7 years after the transaction to comply with IRS record-keeping requirements and applicable state regulations.
- Authentication logs: OTP request logs retained for 90 days for fraud detection and security audits.
- Support communications: Retained for 3 years after the conversation closes.
- Server logs: Raw access logs purged within 90 days.
11. Third-Party Links
Our platform may contain links to third-party websites (e.g., shipping carrier tracking pages, brand manufacturer sites). These sites are governed by their own privacy policies. We are not responsible for the privacy practices of third-party sites and encourage you to review their policies before providing any personal information.
12. Changes to This Policy
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date at the top and, where appropriate, notify you by email or via a notice on the platform. Continued use of our services after the effective date of any change constitutes your acceptance of the updated policy.
