Fire Kicks is not affiliated with, endorsed by, or sponsored by any of the brands we sell. This includes (but is not limited to) brands such as Nike, Adidas, Supreme, Jordan, New Balance, or any other manufacturers represented in our catalog.

We are a 100% independent business that legally sources products through private sellers, collectors, wholesalers, and other secondary market channels. All items are acquired lawfully and resold under the protections of U.S. law.

The First Sale Doctrine (Title 17 U.S. Code § 109) protects our legal right to resell trademarked and copyrighted items we have lawfully purchased. Once a genuine item is sold by or with the consent of a trademark or copyright holder, the original owner’s right to control future resale is "exhausted."

This means:

• We do not need permission to resell authentic products.

• We are allowed to use brand names descriptively to identify items.

• As long as we do not mislead customers or use copyrighted logos or images improperly, we are not infringing on trademark rights.

We mention brand names strictly to describe the products being sold. For example:

“Nike Air Jordan 1 Retro High OG – Size 10 – Pre-owned”

This is a nominative fair use, which means we are using the brand name truthfully and without implying endorsement or affiliation.

We sell both pre-owned and new items. All items are clearly labeled according to their condition:

• New: Brand new in original packaging, purchased from legitimate sources

• Pre-Owned: Lightly used or previously owned, verified for authenticity

• No Box / Replacement Box: Where applicable, packaging condition will be noted

We carefully inspect all items for authenticity and accuracy. In some cases, we use third-party verification services to further confirm the legitimacy of high-value or collectible products.

We take intellectual property rights seriously and strive to:

• Avoid use of copyrighted materials such as logos, promotional images, or text from brand websites

• Use original photos of the actual items being sold

• Comply with takedown requests when properly submitted with proof of ownership
